1 Acceptance of Terms
Welcome to EIS Foundation. These Terms of Use ("Terms") govern your access to and use of the EIS Foundation website (eisfoundation.com), our programs, services, and any associated content (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.
EIS Foundation ("we," "our," or "us") is a Section 8 non-profit company registered under the Companies Act, 2013, in India. These Terms constitute a legally binding agreement between you and EIS Foundation.
2 Eligibility
To use our Services, you must meet the following requirements:
3 Account Registration
When you create an account with us, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and accept responsibility for all activities under your account
- Immediately notify us of any unauthorized use of your account
- Not share your account credentials with others
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
4 Membership Terms
Free Membership: EIS Foundation membership is free of charge. We do not charge fees for program participation, and there are no hidden costs.
As an EIS member, you understand that:
- Selection is Competitive: Membership is granted through a selective application process. Submission of an application does not guarantee acceptance.
- Active Participation Expected: Members are expected to actively participate in programs, projects, and community activities.
- Resource Access: Access to resources (hardware, mentors, facilities) is subject to availability and may be allocated based on project needs.
- No Employment Relationship: Membership does not create an employment, agency, or partnership relationship with EIS Foundation.
5 Code of Conduct
When using our Services, you agree NOT to:
Harass, bully, threaten, or intimidate other users or staff
Submit false, misleading, or fraudulent information
Infringe on intellectual property rights of others
Attempt to hack, disrupt, or compromise our systems
Use resources for illegal activities or commercial purposes without authorization
Misrepresent your affiliation with EIS Foundation
Violation of this Code of Conduct may result in immediate termination of membership and access to Services.
6 Intellectual Property
EIS Foundation IP
The EIS Foundation name, logo, website design, content, and educational materials are the intellectual property of EIS Foundation and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute our materials without prior written permission.
Your Projects
You retain ownership of projects you create. Products, code, designs, and innovations you develop as an EIS member remain your intellectual property. EIS Foundation does not claim ownership of member-created works.
However, by participating in EIS programs, you grant us:
- The right to showcase your work (with credit) for promotional and educational purposes
- The right to include anonymized project data in impact reports
- A non-exclusive license to use project materials in educational content
7 User Content
You may submit content through our Services, including but not limited to applications, project descriptions, forum posts, and comments ("User Content"). By submitting User Content, you:
- Confirm that you have the right to submit such content
- Grant EIS Foundation a non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with our Services
- Accept responsibility for all content you submit
- Agree not to submit content that is illegal, offensive, or violates third-party rights
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate.
8 Disclaimers
IMPORTANT NOTICE
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
EIS Foundation does not warrant that:
- Services will be uninterrupted, timely, secure, or error-free
- Results from using Services will be accurate or reliable
- Any errors in Services will be corrected
- Participation will lead to specific outcomes (jobs, funding, etc.)
9 Limitation of Liability
To the maximum extent permitted by applicable law, EIS Foundation and its directors, officers, employees, mentors, and partners shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to your account
- Any conduct or content of third parties on the Services
- Injuries or damages occurring during in-person events or activities
Our total liability for any claims arising from these Terms or your use of Services shall not exceed the amount you paid to EIS Foundation (if any) in the twelve (12) months preceding the claim.
10 Termination
By You: You may terminate your membership at any time by contacting us at team@eisfoundation.com.
By Us: We may suspend or terminate your access to Services immediately, without prior notice, if:
- You breach these Terms or Code of Conduct
- You engage in fraudulent or illegal activities
- You pose a risk to other members or the organization
- Required by law or legal process
Upon termination, your right to use Services ceases immediately. Provisions that by their nature should survive termination shall survive (including Intellectual Property, Disclaimers, and Limitation of Liability).
11 Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of Services shall be subject to the exclusive jurisdiction of the courts in Dehradun, India.
Before initiating any legal proceedings, you agree to first attempt to resolve disputes informally by contacting us. We will attempt to resolve disputes through good-faith negotiation within 30 days.
